These Terms of Use govern your access to and use of Unchained Digital websites, assessments, forms, funnels, digital products, and related services. Please read them before using the site or purchasing an offer.
1. Acceptance and scope
By accessing or using a website, assessment, form, funnel, or digital product operated by Unchained Digital LLC, including unchaineddigital.net and go.unchaineddigital.net, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the applicable service.
Separate proposals, statements of work, client agreements, event agreements, checkout terms, or product-specific terms may apply. If a separate signed agreement conflicts with these Terms, the signed agreement controls for that engagement.
2. Eligibility
You must be at least 18 years old and legally able to enter a binding agreement. If you use the site on behalf of a company or other organization, you represent that you have authority to bind that organization.
3. Website information
Website content is provided for general informational and commercial purposes. We may update, remove, or change content, features, availability, and offers at any time. We work to keep information accurate and cannot promise that every page will always be complete, current, or error-free.
4. Assessments and recommendations
Assessments, reviews, scores, result categories, and recommendations are educational and strategic tools based on the information you provide. They are not legal, financial, accounting, medical, employment, cybersecurity, or other regulated professional advice. Results do not guarantee a particular business, operational, financial, or personal outcome.
You are responsible for the accuracy and completeness of your answers and for deciding how to use any result. A score or recommendation does not create a client relationship unless both parties enter a separate agreement.
5. AI-enabled services
Some Unchained Digital services use artificial intelligence, automation, data processing, and human review. AI-generated or AI-assisted material may contain errors, omissions, or unexpected results. You remain responsible for reviewing and approving material before relying on it, publishing it, sending it, or using it in a consequential business decision.
Unless a written agreement says otherwise, do not use an Unchained Digital system to make fully automated decisions that determine a person's legal rights or eligibility for employment, housing, credit, insurance, healthcare, or another regulated benefit.
6. Client services
Consulting, strategy, design, implementation, events, systems, AI agents, automation, CRM work, websites, funnels, content, and custom builds are governed by the applicable proposal or client agreement. Scope, responsibilities, access, timing, fees, revisions, ownership, confidentiality, and acceptance criteria will be defined there.
Timelines and results often depend on timely access, accurate information, feedback, approvals, vendor performance, and participation from the client. We are not responsible for delay or failure caused by missing access, inaccurate information, late approvals, third-party systems, or events beyond our reasonable control.
7. Digital products and licenses
Unless stated otherwise at purchase, digital books, playbooks, fieldbooks, workbooks, templates, videos, courses, assessments, and similar materials are licensed to one purchaser for personal or internal business use. Your purchase does not transfer copyright or ownership.
You may not reproduce, resell, sublicense, distribute, publish, upload to a shared library, use to train a competing product or model, remove ownership notices, or create a substantially similar commercial product from the materials without written permission.
8. Your submissions
You retain ownership of materials you submit. You grant Unchained Digital and its service providers a limited right to host, process, reproduce, modify, and use those materials only as reasonably necessary to respond to your request, deliver the purchased product or service, operate the engagement, protect the parties, and comply with law.
You represent that you have the rights and permissions needed to provide the materials and that our authorized use will not violate another person's rights. Do not submit unlawful material, malicious code, confidential information belonging to someone else, or regulated data through a public form.
9. Purchases, billing, and refunds
Prices, payment schedules, subscriptions, cancellation terms, fulfillment details, and refund policies are stated on the applicable checkout page, offer page, or client agreement. You agree to provide current and accurate billing information and authorize the applicable payment provider to process the stated charges.
If product-specific or client-specific terms address refunds, cancellations, access, or charge timing, those terms control. Except where required by law, fees already earned for completed work are not refundable.
10. Electronic communications
When you submit a request, make a purchase, or otherwise communicate with us, you consent to receive electronic communications necessary to respond, fulfill the transaction, deliver services, schedule work, provide support, and administer the relationship.
Marketing communications are subject to applicable consent requirements. You may unsubscribe from marketing emails or opt out of texts by replying STOP or by communicating your preference through any reasonable method. Opting out of marketing does not prevent necessary transactional or service messages.
11. Intellectual property
The websites and their text, design, branding, graphics, assessment architecture, methods, products, downloads, templates, software, and original content are owned by or licensed to Unchained Digital and protected by applicable intellectual property laws.
Unchained Digital, Founder Freedom, OFFLOAD., FIRED., TURNKEY., Real Estate, Unchained., Unchained Experiences, and associated titles, visual systems, and product identities may not be used in a way that suggests endorsement, affiliation, or ownership without written permission.
12. Prohibited conduct
You may not:
- Use the site or services for unlawful, fraudulent, abusive, deceptive, or harmful activity.
- Interfere with security, availability, forms, assessments, systems, or another person's use.
- Attempt unauthorized access, scraping, extraction, reverse engineering, or automated collection.
- Upload malware, infringing content, or information you are not authorized to provide.
- Misrepresent your identity, authority, affiliation, results, or relationship with Unchained Digital.
- Copy, resell, distribute, or commercially exploit protected material beyond the license granted.
13. Third-party services
Our websites and services may use or link to third-party platforms, including CRM, form, hosting, payment, scheduling, communications, storage, analytics, and AI providers. We do not control every third-party platform and are not responsible for its independent content, availability, security, pricing, policies, or performance.
14. Disclaimers
To the maximum extent permitted by law, the website, assessments, free materials, and digital products are provided on an “as is” and “as available” basis. Unchained Digital disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee revenue, savings, growth, leads, sales, rankings, platform approval, event attendance, automation performance, uninterrupted availability, or any specific outcome. Examples and illustrations are not promises of what you will achieve.
15. Limitation of liability
To the maximum extent permitted by law, Unchained Digital and its owners, team members, contractors, and providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, or for loss of profits, revenue, data, opportunities, goodwill, or business interruption arising from the website, an assessment, a digital product, or these Terms.
For any claim not excluded by law, total liability will not exceed the amount you paid Unchained Digital for the specific product or service giving rise to the claim during the six months before the event giving rise to liability, or $100 if you paid nothing. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Unchained Digital and its owners, team members, contractors, and providers from claims, losses, liabilities, and reasonable costs arising from your unlawful use, your violation of these Terms, your submissions, or your infringement of another person's rights.
17. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Before filing a legal claim, the parties agree to make a good-faith effort to resolve the dispute through written notice and direct discussion.
Unless a separate written agreement requires another process, any legal action arising from these Terms or the website must be brought in a state or federal court with jurisdiction in Broward County, Florida, and each party consents to that venue and jurisdiction.
18. Changes
We may update these Terms as our offerings, technology, or legal obligations change. The date at the top identifies the current version. Your continued use after an update becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
19. General terms
If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. We may assign these Terms as part of a business transfer or reorganization.
